Spain Publishes 4 Routes for Foreigners to Get Citizenship

The Spanish government has officially outlined four distinct pathways through which foreign nationals can acquire Spanish citizenship via naturalisation. These routes, published under Spanish nationality law, cover acquisition by option, discretionary conferral, residency, and possession of status. Each route leads to registration in the Spanish Civil Register, granting the right to apply for a national identity card and passport.

Citizenship by Option

The first route, citizenship by option, applies to individuals with close family ties to Spanish citizens. This includes those who are or have been under the parental authority of a Spanish national, persons whose mother or father was Spanish and born in Spain, and adopted individuals over 18. Applications are handled through Civil Registers, requiring documentary evidence of the familial relationship.

Two special procedures exist under this route. Law 52/2007, the Historical Memory Law, extends the option to descendants of Spaniards exiled during the Civil War and Franco dictatorship. Law 20/2022 on Democratic Memory further broadens eligibility to those born outside Spain to parents or grandparents who originally had Spanish nationality but lost or renounced it due to persecution based on political, ideological, religious, or sexual orientation grounds.

Discretionary Conferral and Residency

The second route, discretionary conferral, is granted by Royal Decree on a case-by-case basis. Applicants must demonstrate exceptional circumstances in culture, sport, science, or humanitarian service. A specific version exists for Sephardic Jews of Spanish origin under Law 12/2015, requiring proof of Sephardic heritage and a demonstrable connection to Spain.

The third and most commonly used route is acquisition by residency. It requires continuous, legal residency in Spain for a period that varies by nationality and personal circumstances. Only residency permits issued under immigration legislation count, and the applicant must prove uninterrupted, legally valid residency immediately before applying.

Possession of Status and Eligibility

The fourth route, acquisition by possession of status, is rare and applies to individuals who have openly used Spanish nationality in good faith for at least 10 years, even if that nationality record is later annulled.

Eligibility across all routes is broad. Foreign nationals of any background may explore the residency route, making it the most accessible for non-EU citizens, including Africans, living and working legally in Spain. Each route has specific procedural requirements, and the Spanish government assesses applications individually.

In a related development, the United States government outlined three employment-based pathways for a Green Card, covering workers with extraordinary ability, advanced degrees, and physicians serving underserved communities, as reported by Legit.ng.
