General 10-Year Rule Applies to Most Foreigners

The standard residency requirement stands at ten years of continuous legal residence in Spain. This applies to the majority of foreign nationals who do not qualify for any special category or exception.

Shorter Periods for Refugees and Nationals of Certain Countries

Refugees who have been granted official protection status can apply after five years of legal residency. A two-year residency period is available to nationals of Latin American countries, Andorra, the Philippines, Equatorial Guinea, and Portugal, as well as individuals of Sephardic origin. This reduced timeframe reflects Spain's historical, cultural, and linguistic ties with these nations.

One-Year Route for Specific Personal Situations

The shortest path to citizenship requires only one year of residency and is reserved for a defined group: individuals born on Spanish soil; those who have been under the legal custody or guardianship of a Spanish citizen or institution for at least two consecutive years; persons married to a Spanish national for one year (provided there is no legal or de facto separation at the time of application); widows and widowers of Spanish nationals who were not separated at the time of death; and people born outside Spain to a Spanish-born parent or grandparent.

Beyond Residency: Integration and Good Conduct Requirements

Meeting the residency timeline alone is insufficient. Applicants must also demonstrate good civic behaviour, evidenced by a clean criminal record certificate from their country of origin plus reports from Spanish authorities. Integration into Spanish society is assessed through two tests administered by the Instituto Cervantes: one evaluating Spanish language proficiency and another testing knowledge of Spain's constitution and sociocultural framework. Only residency permits or authorisations issued under Spanish immigration legislation count as valid legal residency for the purpose of this application.

According to the Spanish government publication, the nationality-by-residence procedure is the most common naturalisation pathway. The rules aim to ensure that applicants have established genuine ties to Spain and are prepared to become full members of society.
