Turkey has clarified that marriage to a Turkish citizen does not automatically grant citizenship to a foreign spouse. Under Article 16 of Turkish Citizenship Law No. 5901, foreign spouses must be married for at least three years before they become eligible to apply for citizenship. The three-year period must be continuous, and the marriage must still be ongoing at the time of application.
Three-Year Marriage Requirement
The National Civil Registration System of Turkey governs the process. Foreign spouses who meet the three-year marriage requirement can submit an application, but approval is not guaranteed. The law emphasizes that marriage alone does not confer citizenship or passport rights. Applicants must also satisfy other conditions, such as good conduct and no threat to public order.
Marriage Dissolution and Citizenship Retention
Special provisions apply if the marriage ends after an application is filed. If the Turkish spouse dies after the application date, the process may continue. If the marriage is later declared null and void, a foreign national who acquired citizenship through that union may retain it only by proving they acted in good faith at the time of marriage. In such cases, the matter is referred to the relevant ministry through the Governorate for a decision.
Entry with National ID Card
In related news, Turkey's Ministry of Foreign Affairs released a list of 21 countries whose nationals can enter Turkey using a national ID card instead of a passport. Most are European nations, including Georgia, Ukraine, Azerbaijan, and Moldova. This measure simplifies travel for citizens of those countries but does not affect citizenship requirements for foreign spouses.
