Court Grants Interim Injunction in Disputed Lekki Land Linked to Alausa

Justice Babatunde Oladapo Kalaro of the Lagos High Court has issued an interim injunction in a contentious dispute over a Lekki property, which is reportedly connected to a company owned by the Minister of Education, Dr Maruf Olatunji Alausa. The order was delivered at the Lagos Judicial Division in Ikeja on Tuesday, March 10, 2026, and was officially obtained by The Guardian on the following day.

Details of the Legal Application

The injunction stems from an ex parte application filed by Advance Lincoln Limited against the Lagos State Government and three other defendants, concerning the ownership and control of the land in question. The case, marked LD/5991LM/2026, also names the Attorney General of Lagos State, the Land Use and Allocation Committee under the Lagos State Ministry of Lands, and Lincoln Advanced Radiology Service Limited as defendants.

The claimant is seeking relief for a parcel of land measuring approximately 3,913.359 square metres located at Lekki Peninsula Scheme II in Lagos State. This property is covered by a Certificate of Occupancy dated April 11, 2014, which has been duly registered at the Lagos State Lands Registry.

Court Orders and Restrictions

After reviewing the application, Justice Kalaro granted an interim injunction that restrains the defendants, along with their agents, privies, or servants, from undertaking any further actions on the property. Specifically, the court has prohibited any acts of trespass, sale, lease, alienation, or interference with the land until the motion on notice is fully determined.

The application was supported by an affidavit sworn by Wale Arowosaye, a litigation officer, and was based on an ex parte motion dated February 24, 2026. Counsel for the claimant, Akinlabi Apara, presented the motion in court, while no representatives appeared on behalf of the defendants during the proceedings.

Further Directives and Next Steps

In addition to the injunction, the court directed all parties to comply with the pre-action protocol and to maintain the status quo ante bellum regarding the property. The claimant has been ordered to serve the motion on notice and the court's enrolled order on all defendants within a strict timeframe of seven days.

The case has been adjourned to April 17, 2026, for a compliance report, which will assess whether the parties have adhered to the court's directives. This legal development highlights ongoing tensions over land ownership in Lagos, particularly in high-value areas like Lekki, and underscores the judicial system's role in resolving such disputes impartially.
