We, the Indigenous Ijaw and Urhobo people of Warri Federal Constituency in Delta State, write this open letter to President Bola Ahmed Tinubu to express our deep concern over the attack on the rule of law and democracy arising from the implementation of the Supreme Court judgment on fresh delineation of electoral wards and polling units.
Background of the Supreme Court Judgment
On December 2, 2022, after an 11-year legal battle, the Supreme Court ordered the Independent National Electoral Commission (INEC) to conduct a fresh delineation of electoral wards and polling units for Warri South West, Warri North, and Warri South Local Government Areas. INEC, as a law-abiding agency, held stakeholder meetings and conducted fieldwork from July 10 to 19, 2024. The final report was released on May 20, 2026, creating two additional state constituencies and recommending a new Warri Federal Constituency II.
Presidential Interference
However, jubilation turned to dismay when the Presidency ordered INEC to halt implementation due to objections from the Itsekiri ethnic nationality. We believe this decision stems from the President's matrimonial ties to the Itsekiri. This directive undermines the 1999 Constitution, the Supreme Court's finality, and INEC's independence.
Violation of Oath of Office
President Tinubu swore to defend the Constitution and do right to all without fear or favour. His action violates that oath. Section 287(1) of the Constitution mandates that Supreme Court decisions be enforced by all authorities. Stopping INEC from implementing the judgment is a direct attack on the rule of law.
INEC Independence Must Be Respected
Section 160(1) of the Constitution provides that INEC's powers to regulate its procedure shall not be subject to presidential approval or control. The President's directive disrespects this independence and sets a dangerous precedent.
Our Prayers
- The constitutional independence of INEC must be respected by all federal agencies.
- The Presidency should cease interference in INEC's statutory duty to implement the fresh delineation as ordered by the Supreme Court for the 2027 elections.
