The Australian Department of Home Affairs has clarified that foreign workers and permanent residents must live in Australia for at least four years on a valid visa before they can apply for citizenship by conferral in 2026. This requirement, published in the department's official guidelines, aims to ensure applicants have demonstrated a genuine commitment to life in Australia.
Key Residency Requirements for Australian Citizenship
According to the department, to qualify for citizenship by conferral, an applicant must have been living in Australia on a valid visa for four years immediately before the date of application. Within that four-year period, they must have held a permanent visa or a Subclass 444 Special Category Visa (SCV) for at least the last 12 months before applying.
The department also imposes strict limits on time spent outside Australia. Applicants must not have been absent from the country for more than 12 months in total across the four-year period. Additionally, in the 12 months immediately before applying, absences must not exceed 90 days in total.
Exemptions and Special Provisions
In certain circumstances, the department may exempt applicants from the general residence requirement. This includes cases where the applicant has already spent a significant amount of time living in Australia. Special provisions also apply to New Zealand citizens holding an SCV or a New Zealand stream Skilled Independent visa under Subclass 189, with separate rules affecting how their qualifying period is calculated.
Related Visa Pathways
In a related development, the department had earlier shared how long foreigners must reside in the country before seeking citizenship. Additionally, the Australia global talent visa, officially known as the Subclass 858 visa, is not open for general applications. Prospective applicants must first submit an Expression of Interest and receive a formal invitation before lodging an application.
