A former police officer, Ayodeji Awenebi, has been arraigned before an Akure Chief Magistrate’s Court in Ondo State over the alleged defilement of a six-year-old girl. The defendant, whose address was not disclosed, faced a single count of defilement.
Details of the Alleged Offence
The prosecutor, Assistant Superintendent of Police Nelson Akintimehin, informed the court that the incident occurred on November 30, 2025, at Ode Community, Isingbo, within the court's jurisdiction. The prosecutor alleged that Awenebi, aged 25, unlawfully defiled the minor without her consent. This act, according to the prosecutor, contravenes Section 22 of the Criminal Code, Cap 37, Vol. 1, Laws of Ondo State of Nigeria, 2006.
Defendant's Plea and Legal Arguments
The defendant pleaded not guilty to the charge. His counsel, A.O. Odidiomo, requested an adjournment on health grounds. Odidiomo further prayed the court to grant bail on the most liberal terms, arguing that despite the seriousness of the allegation, the defendant is presumed innocent under Section 35 of the Constitution until proven otherwise. He also assured the court that the defendant would not be a flight risk and would not interfere with the investigation or witnesses.
Court Ruling and Bail Conditions
Chief Magistrate Sunday Adedapo granted bail to the defendant in the sum of N750,000, with one surety in the same amount. The court stipulated that the surety must reside within the court's jurisdiction and own landed property in Akure. The case has been adjourned to April 30 for further hearing.
