A Federal High Court in the Federal Capital Territory has intervened to stop the potential sale of a commercial aircraft at the centre of a financial dispute. The court issued a crucial interim order, putting a hold on the transaction and demanding explanations from the parties involved.

Court Order Grounds Aircraft Sale

Justice M. A. Madugu of the FCT High Court sitting in Bwari issued the restraining order on Friday, December 5, 2025. The order specifically bars Galactic Aviation Limited, Mr Abdullahi Ahmed, and NG Eagle Airline Limited from selling or attempting to sell an Embraer EMB-145LR aircraft with registration mark 5N-BZM.

The judge made this decision after hearing an ex parte application filed by the claimant, Reekers Engineering and Construction Limited. The application was argued in court by the claimant's lead counsel, Mr Azeez Taiwo Hassan (SAN), in a suit identified as FCT/HC/BW/CV/391/2025.

Parties to the Suit and Key Allegations

The lawsuit names four respondents. They are Galactic Aviation Limited as the first respondent, Mr Abdullahi Ahmed as the second, NG Eagle Airline Limited as the third, and the Honourable Minister for Aviation and Aerospace Development as the fourth respondent.

A central claim in the case is that the aircraft, with Manufacturer Serial Number 14500842 and engine serial numbers ESN 25606 and ESN 25831, has not been fully paid for. The claimant alleges that the first and second defendants are responsible for this outstanding payment.

Defendants Given Seven Days to Show Cause

In his ruling, Justice Madugu did more than just halt the sale. He also issued a "show cause" order directed at the defendants. The court ordered the defendants to provide reasons within seven days why the key requests made by Reekers Engineering in their ex parte motion should not be granted by the court.

This legal step requires the defendants to formally respond to the allegations and present their defence against the claimant's prayers for permanent relief.

Next Hearing Date Set

The court has scheduled the next hearing in this matter for December 16, 2026. This date will allow for the full hearing of the motion, considering the responses from the defendants to the show cause order.

This legal development highlights the use of court injunctions to preserve assets that are subject to litigation. It ensures that the disputed Embraer jet remains available pending the final resolution of the underlying financial conflict between the companies.
