Lagos Court Sentences Cleric to Life Imprisonment for Assaulting Church Member's Daughter

A Lagos Special Offences Court in Ikeja has delivered a landmark judgment, convicting and sentencing a 63-year-old cleric, Chris Douglas, to life imprisonment for the assault of a church member's daughter. The ruling, handed down by Justice Rahman Oshodi, underscores the severe psychological harm inflicted on the victim and the abuse of authority by the defendant.

Details of the Case and Court Proceedings

The court found that Douglas, a pastor at Peculiar Generation Assembly Church in Oshodi, exploited his position of trust to assault the victim, who was 18 years old at the time of the incidents. The offences occurred at a hotel where the cleric took the victim on multiple occasions, with the court noting that the victim and her family had relied on him for guidance and support.

During the trial, the prosecution, led by Director of Public Prosecution Dr Babajide Martins, and the defence, represented by Mr Yusuf Temilola Nurudeen, called a total of 10 witnesses. The prosecution presented five witnesses, including the victim, her mother, and a medical doctor, and submitted documents admitted as exhibits. Evidence highlighted the emotional impact on the victim, such as depression and recurring distress.

Victim's Testimony and Legal Arguments

Testifying before the court, the victim's mother recounted confronting the cleric at his church after discovering the incident, where he apologised in the presence of church elders. The matter was later reported to a human rights organisation and the police, leading to the victim's referral to the Mirabel Centre for medical examination.

The defendant denied the allegations, claiming the relationship was consensual. However, the court rejected this defence, holding that the victim's testimony was credible and corroborated by medical evidence. Justice Oshodi examined testimonial, medical, and electronic evidence, alongside objections raised by the defence under the Evidence Act, 2011.

Court's Ruling and Sentencing

While the court agreed that some documents were improperly admitted and should be disregarded, it upheld the oral testimony of medical expert Dr Maria Fadaka as admissible and credible. The judge noted that the prosecution did not establish some allegations linked to earlier periods but found sufficient evidence to support charges related to later incidents.

The court acquitted Douglas of six counts but found him guilty on three counts. He was sentenced to life imprisonment on each count, with the sentences to run concurrently. Additionally, the court ordered that his name be entered in the Sexual Offences Register maintained by the Lagos State Government.
