On 22nd May 2026, the Federal High Court delivered rulings in the ongoing legal dispute between Rite Foods Limited and Mamuda Beverages Nigeria Limited. The court held that Mamuda Beverages had complied with the terms of the consent judgment entered on 4th March 2025 in Suit No FHC/ABJ/CS/139/2025. Consequently, the court refused to order the confiscation and destruction of the popular 'Pop Power' Energy Drink produced by Mamuda Beverages, as sought by Rite Foods.
Compliance with Consent Judgment
The court noted that Mamuda had made changes to its product in accordance with the judgment. Specifically, it altered the bottle cap color from bright yellow to 'golden olive' and changed the bottle from black to 'olive green'. Additionally, the word 'classic' on the bottle was replaced with 'original', and border lines were changed to yellow. Mamuda also withdrew all 'Pop Power' energy drinks with the 'classic variant' from the market, as ordered.
Background of the Dispute
Rite Foods, concerned about the rising market dominance of 'Pop Power', had approached the Federal High Court in January 2026 seeking an Anton-Pillar injunction to remove the product from the market. This action came despite the earlier consent judgment that had settled the trademark dispute. The court found that Mamuda had complied with that judgment.
Court Rulings
Although the court held that the new action by Rite Foods was not an abuse of process, it did not order the confiscation of 'Pop Power' drinks. Instead, the court directed Mamuda to dispose of already produced energy drinks through sale before the end of the year or before the case determination, whichever comes first. The matter was adjourned to 23rd September 2026 for hearing.
Response from Mamuda Beverages
Mamuda Beverages dismissed misleading reports alleging court-ordered confiscation, attributing them to mischief-makers threatened by Pop Power's market success. The company emphasized that Pop Power is a legitimate product developed through substantial investment, planning, and quality control. Mamuda urged journalists to adhere to principles of truth, accuracy, and accountability, and warned against false narratives. The company stated it would take legal action against any media or individuals spreading misinformation. Mamuda reaffirmed its commitment to lawful competition, job creation, and serving Nigerian consumers.
