A Washington state teacher accused of engaging in sexual activities with two of her teenage adopted sons was apprehended after her estranged husband handed over incriminating text messages, authorities said.

Details of the Case

Amber Swain, 35, of Newport, was charged with incest earlier this month following the exposure of her alleged sexual relationships with the 17- and 18-year-old boys, according to court documents.

In a sexually charged text message, one of Swain's adopted sons expressed a desire to sleep in her bed again, just once, as per the documents obtained by the Daily Mail. Swain replied, "No, I love you so much. Nothing like that is ever going to happen. You will find someone who you love being with like that and care about."

The mother of six, who also served as the former executive director of Spokane Angels, a nonprofit supporting foster children, is accused of beginning a sexual relationship with one of the boys in December, when he was 17.

She adopted one of the boys after initially meeting him as a struggling third-grader in her classroom in 2017, authorities stated.

Police Interviews

During police interviews, one of the adopted sons alleged that he had sex with Swain many times, including just two days prior to the interview. The teen claimed Swain asked him, "Should we be doing this?" during their first encounter, to which he responded, "Yes."

The boy who texted Swain about wanting it to happen again told investigators he grew suspicious that his mother was also involved with his brother after finding her underwear on his sibling's bedroom floor and discovering them in a locked room together.

He recounted falling asleep in Swain's bed and waking to find her climbing in beside him, describing it as "normal" since they had cuddled since he was young. When pressed for specifics, he said, "Things got handsy, that's all I'm going to say," and described putting his hand inside her clothing and changing positions several times before she moved his hand away.

Swain's Statements

Initially, Swain denied any sexual contact with her adopted son. Later, she claimed the boy touched her leg while she was asleep, and she froze and moved it away twice. Eventually, she told cops she did not know why but she "leaned in," adding she was "like half asleep or something" before pushing his hand away.

Swain also denied a sexual relationship with the other boy but eventually admitted to having sex with him starting in February of this year, according to the affidavit. Detectives informed her that the victim said their relationship started in December 2025, when he was 17.

Arrest and Legal Proceedings

Swain was arrested on suspicion of first- and second-degree incest on June 2 after her estranged husband, from whom she is separated, turned over the text messages to Washington's Department of Children, Youth and Families.

She was placed on administrative leave from Pend Oreille River School, the Newport School District's alternative high school, following her arrest.

Swain had previously built a public profile advocating for foster children as executive director of Spokane Angels. She pleaded not guilty at her arraignment on June 8 and faces up to 10 years in prison if convicted. Her trial is scheduled for October 6.
