Turkey's government has officially clarified that marriage to a Turkish citizen does not automatically grant foreign spouses citizenship. According to the country's Directorate General of Civil Registration and Citizenship, foreign nationals must satisfy three specific conditions under Article 16 of Turkish Citizenship Law No. 5901 before they can apply for citizenship through marriage.
Three-Year Marriage Requirement and Ongoing Union
The first fundamental prerequisite is that the foreign spouse must have been in a continuous marriage with a Turkish citizen for at least three years. The marriage must still be ongoing at the time of application. This rule is strictly enforced, with no exceptions for shorter marriages.
Three Conditions for Marriage-Based Citizenship
Beyond the three-year marriage duration, applicants must also meet three additional conditions. First, the couple must be living together as a family unit. Second, the foreign spouse must have refrained from any conduct incompatible with the marital relationship. Third, there must be no circumstance that presents a threat to national security or public order.
All three conditions must be met concurrently at the time of application. The law provides flexibility only in one specific scenario: if the Turkish citizen spouse dies after the application has been submitted, the requirement to be living together as a family unit is waived.
Consequences of Marriage Annulment
The guidance also addresses cases where a marriage that led to citizenship is later declared null and void. The foreign national does not automatically lose Turkish citizenship if they were acting in good faith when the marriage took place. However, if the marriage is annulled, the matter does not remain at the local level; the relevant Governorship must refer the question of citizenship retention to the Ministry for a final determination.
Broader Context of Turkish Citizenship Policy
This clarification comes amid Turkey's ongoing efforts to regulate immigration and citizenship. In a separate development, the Turkish Ministry of Foreign Affairs published a list of 21 countries whose nationals can enter Turkey using only a national ID card. Most of these countries are European nations, along with Georgia, Ukraine, Azerbaijan, and Moldova.
The Directorate General emphasized that marrying a Turkish citizen is not a shortcut to citizenship. The three-year marriage period and the three conditions are designed to ensure that citizenship is granted only to genuine families that contribute to Turkish society without posing security risks.
