Jigawa Court Delivers Landmark Ruling on Decade-Long Unlawful Detention
In a significant judicial decision that underscores the sanctity of constitutional rights, the Jigawa State High Court has mandated the immediate release of a Nigerian citizen, Ja'o Sabo, who endured more than ten years in detention without facing trial. Presiding Justice Ado Yusif Birnin-Kudu delivered this landmark judgment on Tuesday, January 7, following a fundamental rights enforcement suit brought before the court.
Compensation and Apology Ordered for Gross Rights Violation
The court awarded Sabo N10 million in damages as compensation for the prolonged and unlawful detention that began in 2014. Justice Birnin-Kudu ruled that this detention constituted a gross violation of Sabo's fundamental rights, specifically citing breaches of Sections 35, 36, 41, and 46 of the 1999 Constitution of the Federal Republic of Nigeria (as amended).
In addition to the financial compensation, the judge directed the respondents—comprising the Attorney-General of Jigawa State, the Jigawa State Government, and the Commissioner of Police—to issue a public apology to Sabo. This apology must be broadcast on major radio stations across Jigawa State, ensuring widespread acknowledgment of the injustice suffered.
Background of the Case and Legal Implications
Sabo was arrested in 2014 on allegations of criminal conspiracy and armed robbery. Despite these serious charges, his case never proceeded to trial, leaving him in custody for over a decade without legal recourse. The court's ruling highlights systemic issues in the justice system, particularly regarding prolonged detentions without due process.
Justice Birnin-Kudu emphasized that such practices undermine the rule of law and erode public trust in judicial institutions. By ordering both compensation and a public apology, the judgment aims to provide redress for Sabo while setting a precedent to deter similar violations in the future.
This case serves as a stark reminder of the importance of upholding constitutional safeguards against arbitrary detention. It also reflects ongoing efforts within Nigeria's judiciary to address human rights abuses and ensure accountability among law enforcement and government agencies.
