Public affairs analyst Anyakweh Miracle Amadi, Esq., has strongly criticized the Independent Corrupt Practices and Other Related Offences Commission (ICPC) for releasing former Kaduna State governor Nasir El-Rufai from custody following his mother's death without obtaining a court order. Amadi asserts that this action represents a significant breach of Nigerian constitutional and legal frameworks governing arrest, bail, and detention procedures.

Constitutional Concerns Over ICPC's Decision

Amadi emphasized that the power to grant bail rests solely with the courts, not with agencies like the ICPC. He stated, "Granting of bail is not at the discretion of the ICPC but at the instance of the Laws of Nigeria. It is only the Court that has the unfettered power to grant bail based on its discretion." He explained that once a court orders detention, the ICPC loses authority to release a suspect on bail, making El-Rufai's release without judicial approval a grave departure from legal norms.

Exceptions to the Rule

The lawyer outlined limited exceptions where the ICPC might have legal grounds for release:

  • Conditional Release: If a court order explicitly empowers the ICPC to grant bail upon meeting specific conditions set by a judge, such as providing sureties or a bail bond.
  • Time Limits: If a suspect has overstayed the detention period covered by a court order, the ICPC may administratively release them to protect fundamental rights, provided no investigation indicts them, or charge them to court for arraignment.

Amadi argued that El-Rufai's release on compassionate grounds due to his mother's death does not fall under these exceptions, highlighting that "bail on compassionate grounds must be based on the law and not emotions."

El-Rufai was released by the ICPC shortly after the death of his mother, Hajiya Umma El-Rufai, in Cairo, Egypt. While in custody, he focused on personal activities. The release sparked mixed reactions, with condolences from President Bola Ahmed Tinubu, Governor Uba Sani, and National Security Adviser Nuhu Ribadu. However, legal experts have condemned the move. Senior Advocate of Nigeria Femi Falana described it as illegal, stating that no agency can override a court order. Human rights lawyer Inibehe Effiong and veteran journalist Richard Akinnola also questioned the ICPC's procedures, raising concerns about selective enforcement and adherence to the rule of law.
