Woman Seeks Divorce, Claims Husband is a 'Figurehead' in Oyo Court

A woman identified as Abiodun has formally approached the Grade A Customary Court in Mapo, Ibadan, Oyo State, seeking the dissolution of her marriage to her husband, Damilola. In her petition, Abiodun cited grounds of irresponsibility, troublesomeness, and battery, painting a picture of a household where she bears the overwhelming burden of responsibilities.

Allegations of Neglect and Abuse

Abiodun told the court that Damilola functions merely as a figurehead in the home, claiming the title of head of the household without fulfilling any associated duties. She asserted that he daily shirks his responsibilities towards her and their five children, instead passing the buck entirely to her. According to her testimony, she is the sole provider, responsible for feeding the family and paying the children's school fees.

The plaintiff further explained that despite the heavy weight of these responsibilities, her husband remains troublesome and denies her any peace of mind. Shockingly, she stated that the rewards for her loyalty and devotion to the family have been severe beatings, which she alleges occur almost daily.

Pleading for a New Beginning and Child Custody

Expressing a desire to move on with her life, Abiodun pleaded with the court to dissolve the marriage. She also made specific requests regarding their children:

  • She entreated the court to grant her custody of all five children.
  • She begged the court to mandate her husband to be financially responsible for their upkeep, with priority given to feeding, education, and healthcare.

In her detailed account, Abiodun revealed that Damilola never paid her bride price and they began cohabiting shortly after meeting. She described him as irresponsible and neglectful, alleging he cared little if she or the children starved. She laboriously worked all day to ensure there was food on the table, with the children's school fees automatically becoming her duty.

Final Straw and Court Proceedings

The situation reportedly escalated to the point where Damilola threw her out of their home in August of last year. "My lord, I want to pick up the pieces of my life," Abiodun told the court. In addition to seeking dissolution and custody, she implored the court for an order restraining her husband from encroaching on her privacy in the future.

In his response, Damilola agreed that they should go their separate ways. The president of the court, Mrs. S.M. Akintayo, has adjourned the case until April 20 for the defence to present its side. This case highlights ongoing issues of domestic responsibility, financial neglect, and abuse within marital disputes being brought before Nigerian customary courts.
