Retired Judge Questions Legitimacy of Peter Obi's 2023 Presidential Bid
Nigeria's judicial system is facing renewed scrutiny after a retired senior judge made controversial remarks about the 2023 presidential election. Justice Isa Salami, the former President of the Court of Appeal, asserted that Peter Obi, the former governor of Anambra State, should not have been permitted to contest the election under the Labour Party banner.
Constitutional Grounds for Salami's Claim
Justice Salami presented his argument during an award ceremony hosted by the Wole Soyinka Centre for Investigative Journalism at his residence in Ilorin, Kwara State, on Tuesday, March 24. He received the award from Dapo Olorunyomi, the Founder and Executive Director of WSCIJ, and Motunrayo Alaka. Salami emphasized that his criticism is rooted in constitutional and electoral law technicalities.
He explained, "Peter Obi ought not be allowed to contest the 2023 presidential election. In the sense that by the time he lost the PDP primary, LP had submitted its list of members to the Independent National Electoral Commission. And the Constitution says there cannot be an independent candidacy." Salami further questioned how Obi became the Labour Party candidate without being a registered member, drawing a parallel to the case of Kano State Governor Abba Yusuf, who recently defected to the All Progressives Congress despite not being listed in the NNPP's register.
Mixed Reactions from the Public
The retired judge's statements have ignited a wave of diverse opinions across Nigeria. Many citizens took to social media and other platforms to express their views, highlighting the ongoing debate about electoral integrity and judicial competence.
Biodun Adeyanju commented, "Most commentators didn’t read the body of the message, except for the headline. This is not how to grow intellectually; that's why you have keypad warriors with little or no intelligence to match in their areas of agitation. The technical factor cited by the judge is enshrined in electoral law." Others, like Ola Alex, suggested Obi should seek weaker parties in future elections, while Excellent Touch questioned the legitimacy of other politicians, such as Senate President Godswill Akpabio.
Uche Orji demanded clarity, stating, "Show Nigerians the law, or regulate your lawlessness." These reactions underscore the polarized nature of political discourse in Nigeria, with some supporting Salami's legal perspective and others dismissing it as partisan.
Broader Implications for Nigeria's Electoral System
Justice Salami's critique extends beyond Peter Obi's candidacy to address broader issues within Nigeria's judiciary. He attributed some wrongful court verdicts to the incompetence and inadequacy of certain justices, calling for reforms to strengthen the legal framework. This incident adds to the ongoing conversations about electoral transparency and the need for stricter adherence to constitutional provisions.
In a related development, Peter Obi has denied allegations made by President Bola Tinubu's media aide, Daniel Bwala, regarding seeking support during the 2023 election. Obi dismissed the claims as unworthy of response, reaffirming his commitment to avoiding political transactions. As Nigeria approaches future elections, this controversy highlights the critical role of legal scrutiny in shaping democratic processes and public trust.
