The Federal High Court in Abuja has delivered a stern verdict, sentencing 76-year-old grandfather Francis Omofe to 40 years imprisonment for drug-related offences. This landmark ruling underscores the judiciary's firm stance against narcotics trafficking in Nigeria.

Details of the Arrest and Charges

Omofe was apprehended in Abuja on June 18, 2024, while operating a Nissan Frontier vehicle bearing a police force number plate: NPF 558D. He was transporting a substantial quantity of cannabis sativa from Edo State to Kaduna State at the time of his arrest.

The National Drug Law Enforcement Agency (NDLEA) filed charges against Omofe, identified as a resident of Goni Gora in Kaduna State. The charges, marked FHC/ABJ/CR/286/2024, accused him of possessing 340.8 kilogrammes of cannabis sativa, a prohibited narcotic substance, along Kuje Road in Abuja on or about June 18, 2024.

This offence contravenes Section 19 of the National Drug Law Enforcement Agency Act CAP N30, Laws of the Federation of Nigeria, 2004. In a second count, the NDLEA accused Omofe of transporting 340.38 kilogrammes of cannabis sativa in the same vehicle on the same date and location, violating Section 11(p) of the same Act.

Court Proceedings and Judgment

Justice James Omotosho presided over the case and delivered the judgment on Friday. He ruled that the prosecution had successfully proven both charges beyond reasonable doubt, leading to Omofe's conviction.

Despite pleas for leniency, Justice Omotosho emphasized the necessity of imposing a severe punishment to serve as a deterrent in the national interest. The judge took judicial notice of the defendant's actions, particularly the use of a vehicle with a police number plate to transport a large commercial quantity of cannabis to the northern region, specifically Kaduna State.

Justice Omotosho highlighted the unacceptable nature of this crime, given that terrorists and bandits in Kaduna State have killed numerous innocent Nigerians under the influence of such substances. This context played a crucial role in the sentencing decision.

Sentencing Details

The court sentenced Omofe to 15 years imprisonment on the first count without the option of a fine. For the second count, which initially carried a life imprisonment term, the judge reduced the sentence to 25 years imprisonment, considering the defendant's advanced age, and also without the option of a fine.

Justice Omotosho ordered that the sentences run concurrently from June 18, 2024, the date of Omofe's arrest. This results in a total effective imprisonment term of 25 years, rather than the cumulative 40 years, due to the concurrent nature of the sentences.

This case serves as a stark reminder of the severe legal consequences for drug trafficking in Nigeria, especially when it involves large quantities and impacts regions plagued by security challenges.
