Cardiff City Loses €122 Million Compensation Case Over Emiliano Sala's Death
A French court has dismissed a substantial €122 million compensation claim filed by Cardiff City in a legal dispute with FC Nantes concerning the tragic 2019 death of footballer Emiliano Sala. The Welsh club initiated this case at a commercial court in Nantes during 2023, seeking damages for loss of income and various other financial impacts resulting from Sala's untimely passing.
Court Ruling and Moral Damages
In its definitive ruling, the court not only rejected Cardiff's claim but also ordered the club to pay €300,000 in moral damages to Nantes. This decision marks a significant legal setback for Cardiff, which had estimated its losses at €122 million following an internal analysis. Since Sala's death, the club has experienced relegation from the Premier League and now competes in the third tier of English football, compounding its financial struggles.
Background of the Tragedy
Emiliano Sala, aged 28, died when the light aircraft transporting him to the Welsh capital crashed into the English Channel on January 21, 2019. This devastating incident occurred merely two days after he completed his transfer from Nantes to Cardiff. The pilot, David Ibbotson, also perished in the crash, adding to the profound loss.
Legal Arguments and Reactions
Cardiff's lawyer, Celine Jones, expressed deep disappointment with the court's decision, stating that the legal action was intended to uncover the full truth and honour Sala's memory. "Today, we bitterly observe that the principles of transparency, integrity, and safety in professional football have not prevailed in this decision," she remarked, highlighting the club's perspective on the matter.
Conversely, Nantes welcomed the verdict, with their lawyer Jerome Marsaudon asserting that the club bore no responsibility for the incident. "We are pleased the court listened to us and confirmed this in clear terms," he said, reflecting Nantes' relief at the outcome.
Previous Rulings and Transfer Details
Cardiff had argued that Nantes, through intermediary agent Willie McKay, organised the private flight that led to Sala's death. However, earlier rulings had already clarified key aspects of the transfer. In 2022, the Court of Arbitration for Sport confirmed that Sala's transfer had been completed before his death. Subsequently, in 2023, FIFA ordered Cardiff to pay the remaining balance of the transfer fee, amounting to just over €11 million out of a €17 million deal.
This series of legal decisions underscores the complex and ongoing ramifications of Sala's tragic death, affecting both clubs financially and legally while leaving a lasting impact on the football community.
