UK Government Provides Pathway for Visa Refusal Reviews
The United Kingdom government has introduced a transparent process for eligible visa applicants to request a review of their application if they believe the procedure leading to the refusal was not properly followed. This initiative aims to ensure fairness in immigration decisions. The review request must be submitted within 14 days of receiving the refusal letter, and only one reconsideration request can be made per application.
Who Is Eligible to Request a Visa Review?
According to the UK government website, the review process is available only to applicants who are currently residing in the UK or have applied from within the UK. Three categories of applicants qualify: those who applied to replace their visa with an eVisa (Transfer of Conditions), those who transferred their indefinite leave to remain to an eVisa (No Time Limit), and those planning to extend their stay, switch their visa, or settle in the UK. Even applicants whose applications were approved can request reconsideration if they believe the type of leave granted or the expiry date is incorrect.
Grounds for Reconsideration and Evidence Requirements
The UK government clarified that this is not a standard administrative review but a reconsideration request based on procedural errors. For Transfer of Conditions (TOC) or No Time Limit (NTL) refusals, applicants can submit new evidence only if it shows the date they applied, proof that their documents were genuine, or evidence that UK Visas and Immigration (UKVI) had received important information before the decision but it was not available to the decision-making team. No other new evidence is permitted.
Steps to Submit a Visa Review Request
Applicants must write a letter explaining why they believe the visa or immigration decision was wrong. The letter should be sent to the team that made the original decision, using the address provided in the decision letter. The request must be submitted as soon as possible and no later than 14 days after receiving the decision. Only one reconsideration request is allowed per application.
